1. Our atelier and order packages

Chanson Personnalisée (chansonpersonnalisee.app) is a bespoke music atelier dedicated to personalized song gifts. The atelier offers two distinct creation packages suited to your needs, both one-time fixed purchases with no subscription and guaranteed delivery within 24 business hours:

• Essentiel Package (29 € incl. VAT): includes composition and production of one (1) complete bespoke song (high-quality 320 kbps MP3 master), custom poetic lyrics, access to a dedicated private listening page, a 24-hour private audition window, and one (1) included free revision.

• Vinyl Keepsake Box Package (39 € incl. VAT): includes composition and production of two (2) distinct musical master versions (Version A and Version B) for comparative choice, synchronized scrolling lyrics, a 3D interactive digital gift box with an animated vinyl turntable, a printable keepsake card (high-res PDF with golden QR code), full master downloads from the musical atelier (lossless WAV + 320 kbps MP3), a 24-hour private audition window, and one (1) included free revision.

The two A/B versions, interactive vinyl gift box and printable keepsake card are exclusive to the €39 Vinyl Keepsake Box package. These three features are not included in Essentiel (€29). Both packages include 24-hour private listening and one free revision.

Fulfillment method: Delivery for all orders is strictly digital (access via your secure client space and email notification). No shipping fees apply, and no physical goods are shipped.

2. Brief and lyrics confirmation

Before checkout, you review and confirm all creative elements: recipient's name, anecdotes, musical mood, and the lyrics. Completing payment constitutes approval of the initial brief, which serves as the reference for our atelier to compose your song.

3. 24h audition, included revision and delivery

Within 24 hours, the musical atelier delivers your order to your private space (one master track for the Essentiel package, or two distinct A/B master versions for the Coffret Vinyle package) and immediately notifies you by email. You have a twenty-four (24) hour window to audition your creation on your private player, select your favorite version (for Coffret Vinyle), or submit your included free revision request.

One complimentary revision: If you want adjustments (lyrics, mood, tempo, or vocals), simply submit your wishes and the atelier will produce a new revised version. Tacit approval: If no revision or selection is made within 24 hours, the order is deemed definitively approved, and the final files and gift page/box are automatically unlocked.

4. Transparent pricing and secure payment

Clear fixed pricing: Our prices are displayed in euros including all taxes (TTC): 29 € for the Essentiel package, and 39 € for the Coffret Vinyle package. Each order is a one-time purchase with no subscription, no hidden fees, and no recurring charges.

Payment is processed securely via authorized providers (such as Waffo Pancake, Stripe, or PayPal). Your bank statement will reflect the descriptor displayed at checkout (e.g., CHANSONPERSO).

5. Cancellation, withdrawal and refunds

Statutory exemption for bespoke creations: In accordance with Article L. 221-28 (3° and 13°) of the French Consumer Code, the 14-day statutory right of withdrawal does not apply to personalized content made to customer specifications or digital content supplied immediately with your express consent. Once the musical atelier begins production, discretionary cancellation is not possible.

No refunds for subjective preferences: Because music is a subjective art, refunds cannot be granted for personal taste, change of mind, or aesthetic preference once the confirmed brief has been honored and audition tracks plus the included revision have been delivered.

Technical remedies and dispute defense: Refunds or remakes apply only in proven cases of duplicate charge, unjustified non-delivery, or an unresolved technical audio defect within 48 hours. Please contact support (support@chansonpersonnalisee.app) before filing any chargeback. Unjustified disputes after accessing the music will be contested with complete digital fulfillment logs.

6. Your song is yours: freedom of use

You retain full ownership of your memories and stories. Upon payment and delivery, your song is entirely yours: you have complete freedom to listen, download the musical atelier’s master, play at celebrations (weddings, anniversaries), share on social networks, or release on streaming platforms of your choice (Spotify, Apple Music, YouTube). The atelier claims no restrictive rights over your memories and collects no royalties on your distribution.

8. Limitation of liability and third-party services

Duty of care and artistic nature: The atelier commits to providing all reasonable care, artistry, and professional diligence in composing, arranging, and producing each bespoke song. Because musical creation is inherently a subjective and emotional artistic work, the atelier's obligation is an obligation of means (duty of care), not of specific artistic result. Conformity of the work is assessed strictly against adherence to the agreed brief and validated lyrics, and the atelier cannot be held liable for subjective aesthetic taste, personal musical preferences, or the recipient's emotional reaction.

Networks and third-party services: The atelier cannot be held responsible for slowdowns, outages, or temporary access failures caused by public telecommunication networks, third-party payment providers (e.g., Waffo, PayPal, Stripe), or user hardware/software incompatibility.

9. Customer obligations, breaches and termination

Lawfulness of submitted content: The customer agrees to provide only lawful, truthful, and respectful anecdotes, names, and briefs that do not infringe on third-party intellectual property or privacy rights. Submissions containing defamatory, abusive, hateful, discriminatory, obscene, violent, or otherwise unlawful material are strictly prohibited. The atelier reserves the right to immediately reject any order violating these standards and notify the customer, without liability for compensation.

Prohibition of fraud and contractual remedies: The customer agrees not to use fraudulent payment methods, attempt reverse engineering of the platform, engage in unauthorized commercial resale, or initiate bad-faith chargebacks (particularly filing an unjustified bank dispute after receiving audio files or gift access). In the event of a material or repeated breach by the customer, the atelier reserves the right, with immediate effect and without prior notice, to: (i) suspend access to the user account and interactive gift boxes, (ii) cancel pending orders without refund, (iii) submit digital fulfillment evidence to payment institutions and competent authorities, and (iv) seek full compensation for all losses incurred, including bank dispute penalty fees.

10. Support, complaints and mediation

Our team is available for any questions at support@chansonpersonnalisee.app and commits to responding within 3 business days. If a dispute cannot be resolved amicably, the client may access free consumer mediation under applicable French regulations.
